Rental Agreement

RENTAL PRICING: Mindful Movements has the right to accept or to refuse rental on a case by case basis. Rental fees for not for profit organizations are negotiable per written request. Tax exemption letter required.

Rental Rate: 2hr minimum and rental time must include a minimum of 30min before event start and 30min after event end.

  • $25 per hour Monday-Friday between 9am- 8pm, any hour after 8pm will be charged at $35/hr
  • $35 per hour on Weekends between 9am-5pm, any hour after 5pm will be charged at $50/hr
  • Use of yoga mats and props $2 per person.
  • Security Deposit: $100

RESERVATION REQUIREMENTS, PAYMENTS & SECURITY DEPOSIT: To reserve your event, please complete and submit the contract form. A payment of 50% the applicable rental fee will be sent as a separate invoice.

The remaining 50% balance of the rental fee is due thirty (30) days prior to the event, along with a $100 security deposit. This deposit is to be held as security for any damages to the facility or as payment, in whole or in part, for any costs or expenses incurred by Mindful Movements resulting from the failure of the Renter to surrender the facility in a suitable condition. Any portion of the security deposit may be retained at Mindful Movements’ discretion. Unless withheld by Mindful Movements, in whole or part, the security deposit shall be returned within fourteen (14) business days following the event.

Mindful Movements accepts local checks and credit cards for payment. Checks should be made payable to Mindful Movements. A fee of $50 will be charged for any checks returned due to insufficient funds.

CANCELLATION POLICY: Once contracted, that time slot is reserved for your event. All cancellations must be submitted in writing at least thirty (30) days prior to the event. Cancellations made less than thirty (30) days prior to event will be subject to a 20% administrative fee.

RENTAL PERIOD: The rental period is a maximum of 8 hours. This time period may be less at Mindful Movements’ discretion, if there is an adjacent previously booked event. Pricing includes 30mins of set-up time prior to the start of the event. Additional set-up time is available upon request and will require additional charges.

Guests have access to the facility and grounds no more than 15 minutes prior to the start of the event and may stay no later than 30 minutes following the event before additional charges are applied. Congregating on the sidewalk or street is not permitted. Guests remaining 30 minutes past the conclusion of your event will result in a charge $25.00 for every 1⁄2 hour increment they remain.

SOUND LEVELS & MUSIC: Mindful Movements is located in a residential neighborhood. We subscribe to a “Good Neighbor” policy and believe that a successful and sustainable business relies on the strength, cooperation, and support of the neighborhood around it. Moreover, the strength of the neighborhood also relies on the responsibility, vitality and strength of the businesses operating within it. We have created our sound policy to ensure residents are not disrupted by any of our events.

Music must end by 10:00 PM. All amplified sound must be at a level so as not to disturb the peace, quiet, comfort or repose of neighboring inhabitants and must conform to St. Louis City Ordinance #67002. Low, amplified music is allowed in the interior. Bands are not allowed. Large speaker systems are not allowed. If the Mindful Movements receives complaints concerning sound levels, it shall immediately and satisfactorily address said complaints.

Mindful Movements reserves the right to refuse any music or performance it deems inappropriate or disruptive. Mindful Movements does not provide any PA equipment or extension cords.

PARKING: Public street parking is available. Parking or driving is not allowed on the property. The streets and sidewalks are not to be blocked at any time.

SECURITY: Mindful Movements does not provide security. Do not leave valuables in your car. Mindful Movements is not responsible for any lost or stolen property from autos or from the premises.

RENTALS: Tables, chairs, linens and other equipment are not available from Mindful Movements. Any rentals, furniture, props or equipment outside of linens must be approved by Mindful Movements thirty (30) days prior to the event. A floor plan of the event with equipment and rentals noted must accompany list. Deliveries must be scheduled and approved by Mindful Movements. We recommend a site visit prior to contracting Mindful Movements.

The sidewalks, corridors, passages, exits, entrances, stairways and ramps of the facility shall not be obstructed or used by the Renter, or the employees, agents, servants, visitors or licensees of Renter for any purpose other than for ingress and egress to and from the facility.

DECORATIONS AND SIGNAGE POLICY: Candles are NOT allowed during a special event, on the inside or outside of the facility without previous written approval.

Rice, confetti, silly string, glitter, spray paint, sidewalk chalk and birdseed are not permitted. Tape, nails, brads or staples cannot be used on the walls, ceiling, floor or furniture. If taping down electric cords, no marring professional gaffers tape must be used. Use of duct tape will result in a fine. All decorations must be removed at the conclusion of the activity. If décor is hung from the ceiling, it must be pre-approved and completely removed, including fishing line/strings/ties. Please advise your vendors, rental companies, caterers and DJs of this policy!

Mindful Movements shall have the right to prohibit any signage or advertising by Renter that, in Mindful Movements’ sole judgment, tends to impair the reputation of the facility, and upon written notice from Mindful Movements, Renter will refrain from or discontinue such advertising/signage.

No Mindful Movements property can be removed from the facility at any time. No heavy furniture or other objects shall be moved over the floors of the rooms, landings or stairs so as to mark them.

ALCOHOL POLICY: The dispensing of any alcoholic beverages must be in accordance with and subject to all Federal, State and Local laws. No alcohol shall be sold at these events. Intoxicating drinks cannot be served to minors. Alcoholic beverages in an open container are not to be taken outside of event.

CATERING: The sink does not have a garbage disposal and no dish scrubbers or detergents are provided. No cooking, baking, frying, grilling or food preparation is allowed in the facility without express prior approval of Mindful Movements. Renter must refrain from any act that may conflict with any of the rules and ordinances of the Board of Health or with any statute or municipal by- laws.

Mindful Movements does not provide catering services. You may use the caterer of your choice. Caterers must have proper licenses. You may bring your own food and drinks.

TRASH POLICY: Adequate trash receptacles are the responsibility of the Renter. The renter needs to bring in the appropriate number of and sizes of receptacles to accommodate the quantity of trash generated by the amount of guests at the event. Please pre-plan proper locations for receptacles on the interior and exterior, including buffets and bars. Trash receptacles will be provided with liners. If you are opening presents or perceive extensive waste, please plan according to bring extra large trash bags.

Following the event, the Renter is also responsible for trash removal to the PROPER sidewalk carts. A rolling landfill trash cart and two rolling recycling carts are provided at the facility perimeter. Empty boxes must be broken down or hauled away. Once these exterior bins are full, excess trash must be hauled away by the renter and disposed of properly. Alley dumpsters are not for the Renter’s use. In the City of St. Louis, such usage is considered illegal dumping. It is the renter’s responsibility to discuss the trash policy and receptacles with his/her caterer. Many caterers provide trash removal as part of their services, please use their service if available to you.

All trash must be collected and removed the same night after the event. The Renter must remove trash, litter or debris generated during the course of the event within the facility and in the garden and grounds. The Renter will incur additional charges for any trash left on the premises, in excess of the perimeter bins. Recycling is encouraged. The Renter will incur additional charges if regular trash is placed in street recycling carts and vice versa. Do not dump anything in lawn, garden or on sidewalk, including food or other waste.

RESTROOM POLICY: Only one restroom is available. Events of a certain size may require additional portable toilets, which will be the responsibility of the Renter. When this is applicable, toilets should be delivered the day of the event and removed by 9:00 a.m. the next morning. Placement of portable toilets must not damage landscaping. Please arrange to be present for delivery and instruct the vendor to treat the grounds respectfully. Permit issuance, exclusive vendor contact information and placement instructions are available from Mindful Movements. Mindful Movements must be notified in advance of such rental.

SMOKING POLICY: Mindful Movements is a non-smoking, non-vaping facility. Smoking and Vaping are permitted outside only. Please dispose of all butts in provided receptacle. Cigarette butts are considered litter; improper disposal will affect deposit reimbursement.

CHAPERONE POLICY & CHILDREN: Mindful Movements does not allow events where the intention is to drop off minors for the event. Minors must be accompanied by a parent or guardian at all times. Children are the sole responsibility of the client. The minor-to-adult ratio may not exceed two minors per adult. Damages incurred by guests and minors will be subtracted from the Security Deposit. Renters must be a minimum 25 years of age, to contract the facility.

REPRESENTATIVE ON CALL: A Mindful Movements representative will be available by phone during the event for EMERGENCIES. The representative shall have complete authority and control of the facility during the rental and shall have the right to complete access at any and all times during the event. The representative is there to protect the best interest of Mindful Movements and has the right to terminate a function at any time, if misconduct is indicated. If a problem arises, the representative will contact the police. The representative does not alleviate the Renter of the Renter’s responsibility to maintain control of guests at all times. There is no office on the premise and therefore no representative will be in person during the event unless cause arises.

ADDITIONAL RESTRICTIONS & POLICIES: Animals may not be brought into or kept in or about the facility, with the exception of service animals. Firearms and concealed weapons are prohibited. Hazardous or toxic materials, wastes and regulated substances are not allowed.

Required issuance of any commercial permits as well as any permit fees are the responsibility of the Renter. Rental does not include storage space for boxes or equipment during event.

Renter must refrain from any act which would in any way create a risk of fire, or conflict with the laws relating to fires or the regulations of the fire department, or result in an increase in the rate of fire insurance covering the building and/or contents and further not to bring or store anything whatsoever therein which would have a like or similar result.

Renter shall give immediate notice to Mindful Movements in case of theft, unauthorized solicitation or accident in the facility, or of defects therein or in any fixtures or equipment, or of any known emergency in the facility.

Renter, having examined the facility or having waived examination of the facility, prior to the execution of this agreement, is satisfied with its physical condition for use of the facility, and said use of the facility shall be conclusive evidence of same.

Renter, it is your responsibility to clean up after your event. Post event cleaning services are available for an additional fee, if schedule three weeks prior to event. All renters must review the Building Exiting Checklist and complete prior to leaving. In the event that the facility has not been cleaned of debris created by your event, i.e. all trash disposed of and anything else that needs attention listed herein, there will be a $100.00 charge for Mindful Movements to have it cleaned. Costs for cleaning of an unusual nature could be assessed to the Renter.

RENTAL PRODUCTS AND SERVICES LIST: Yoga mats and props are NOT included in your venue rental fee. You may need to ask for a late night pickup, if the venue is booked the next day. We have no onsite storage for rentals during other events.

PRE-EVENT WALKTHROUGH MEETING: Prior to your event, you will receive an email with building access and cleaning instructions and cleaning details. The cleaning checklist is included in our event information email as well. Please review this list prior to contracting to verify that you understand what is expected. We will schedule an event walkthrough meeting the day of or prior to your event. During this 20 minute meeting, we will review the email building access instructions; such as how to unlock door, how to disarm alarm, where the cleaning supplies are located, etc... We ask that you bring the people who will be responsible for the clean up process to this meeting. We ask that we have your undivided attention during this important meeting. As there is no Mindful Movements staff on the premises during your event, it is important that you take the time to understand this information. If you are renting audio-visual equipment, we recommend testing the equipment in advance to make sure you understand how your playlists/presentation/video/devises work in conjunction with our equipment. You are responsible for learning this in advance and for the proper care and use during your event.

LIABILITY WAIVER AND BREACH: Mindful Movements and its officers/representatives/volunteers shall not be liable for any and all accidents or injuries within the building or outside the building. RENTER HEREBY AGREES TO INDEMNIFY AND SAVE AND HOLD HARMLESS EACH OF THEM FROM ANY LOSS, LIABILITY, DAMAGE, DEATH OR COST THEY MAY INCUR ARISING OUT OF OR RELATED TO THE FACILITY RENTAL WHETHER CAUSED BY THEIR NEGLIGENCE OR OTHERWISE.

Hold Harmless Clause/Liability and Indemnification: Renter shall defend (by counsel acceptable to Mindful Movements), pay, indemnify and hold harmless Mindful Movements, their agents and employees from and against the following, unless caused by gross negligence or willful acts of Mindful Movements; all claims, demands, fines, suits, actions, proceedings, orders, decrees, judgments, and costs and expenses incurred by Mindful Movements, that result from or in connection with any accident injury, death, property damage out of or from or on account of any occurrence in, upon, at or about the Facility, Building or parking areas during the course of the Event. Renter shall retain all risk of loss with respect to any of the Renter’s property located on or about the Facility. The undersigned Renter expressly agrees that this waiver and release is intended to be as broad and inclusive as permitted by the Laws of the State of Missouri and of any other state wherein such activities may occur, and that if any portion hereof is held invalid, the remainder hereof shall continue in full force and effect. The Renter shall be liable for all costs resulting in actions, intentional or unintentional, of the Renter’s party, or that of any individual or group under contract with the Renter, which leads to damage of the Facility or of the property of Mindful Movements.

Renter agrees that Mindful Movements and its officers/representatives/volunteers are not responsible for any stolen or lost articles.

Renter agrees that if, in breach of this agreement, they institute, or attempt to institute, any judicial proceedings against any of the persons listed in this agreement in connection with Mindful Movements, they shall bring them in the Circuit Court of the city of Saint Louis, Missouri, or in the United States District Court for the Eastern District of Missouri, located in Saint Louis, Missouri, and they consent to personal jurisdiction in those courts. They further agree that, if in breach of this agreement, they institute, or attempt to institute, any such proceedings, they are responsible for all costs and attorneys fees of any person or entity against whom they institute, or attempt to institute, such proceedings. Renter agrees that this contract/rental agreement shall be governed by and interpreted in accordance with the laws of the state of Missouri.

Renter further agrees that in the event that nay clause or provision of this contract/rental agreement shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause of provision shall not otherwise affect the remaining provisions of this contract/rental agreement, which shall continue to be enforceable.

*Renter shall use the facility only for the specific purposes and activities described above. No other purposes shall be permitted unless such other purpose or use is approved by Mindful Movements in writing. Renter shall not allow the facility to be used for any improper, immoral, unlawful, or objectionable purpose, nor shall Renter cause, maintain or permit any nuisance (whether public or private) in, on or about the facility and grounds, including but not limited to, objectionable or harmful noises and odors. Renter shall not commit or suffer to be committed any waste in or upon the facility, except for reasonable wear and tear. Renter shall not use the facility or permit anything to be done in or about the facility which will in any way conflict with any private restrictive covenant, law statute, ordinance or any rule or regulation of SRG or any governmental or quasi-governmental authority.
